Quotations

  1. All quotations remain valid for a period of 30 days from the date of issue.
  2. If Cemetery Trusts or other regulatory bodies do not approve the quoted work, the quotation may be subject to revision.

 

Orders and Modifications

  1. Before any work commences, a deposit or full payment is required, based on order specifics.
  2. A signed order and a signed Cemetery Application Form must be submitted prior to the start of work.
  3. Unless otherwise specified, the quoted price includes all lettering detailed on the quotation form. Any additional letters beyond the agreed amount will be charged at the stated rate per letter.
  4. Any alterations to the original order will result in corresponding price adjustments.
  5. In cases where an order is cancelled, a refund may be considered; however, any costs already incurred will be deducted from the refundable amount.
  6. Special orders placed at the request of the client are final and cannot be cancelled once the material has been purchased and carving or design work has begun.
  7. Estimated completion dates are provided as a guide only and may be affected by factors such as weather conditions and material availability. We do not accept liability for delays.
  8. It is the client’s responsibility to remove any personal items from the grave site before work begins. Tyrrells Memorials is not responsible for any loss or damage to items left by third parties. Should we be required to clear debris, temporary structures, old memorials, vases, or other items, additional charges will apply.

 

Payment Terms and Ownership

  1. We offer the following card facilities including Visa, MasterCard, eftpos, debit and American Express. These payments can be made via online third party service “STRIPE” The majority of cards come with a 1.8% surcharge applicable.
  2. We also accept Cheque, Money order and Cash which result in no surcharge.
  3. Any additional charges incurred beyond the original order, will be communicated, approved and will be added to your account.
  4. Invoices are issued upon completion of work, with full payment due within seven days. A 2.5% monthly interest fee applies to overdue accounts.
  5. Unauthorised chargebacks where a work order has been signed, will be disputed
  6. In the event of estate disputes that result in a perceived lack of responsibility by any one individual, the Cemetery Permit Holder remains responsible for resolving such disputes. All associated memorial works must be paid for in full to Tyrrells Memorials upon completion.
  7. Ownership of the goods remains with Tyrrells Memorials until full payment has cleared. However, once dispatched from our premises or installed at the cemetery, the client assumes full responsibility for the items.
  8. If payment is not made in full, Tyrrells Memorials reserves the right to remove memorials from the cemetery. Notification will be provided to the client where possible prior to removal and reinstallation following payment will incur fees for re-installation of said components.
  9. Prior bad debt over 120 days will result in full payment requests for any future works

 

Material Characteristics and Variability

  1. Natural stone materials such as granite, marble, and sandstone inherently vary in colour and grain pattern. Granite may also display natural imperfections such as black spots, veining, flares, or oxidation (colour changes). These variations are not considered defects, and we accept no liability for such occurrences.
  2. The final product may differ slightly from samples shown to the client. We are not responsible for minor variations between sample materials and those used in construction.
  3. Monument dimensions are calculated from the footing and are approximate. A tolerance of ±5mm applies to individual components.
  4. Tyrrells Memorials is not liable for any losses or damages resulting from delays in the supply or delivery of materials.

 

Foundations and Structural Integrity

  1. Tyrrells Memorials is not responsible for any claims related to pre-existing foundations supplied by Cemetery Authorities.
  2. If excavation at adjacent grave sites undermines the foundation of your monument and compromises its structural integrity, any associated warranty conditions will become void.

 

Regulations and Permit Compliance

  1. Cemetery Trusts and governing bodies may reject or require modifications to submitted Cemetery Permits. Tyrrells Memorials cannot be held accountable for any changes to Australian Standards, Cemetery Regulations, or other governing authorities’ requirements.

 

Guarantee and Warranty

  1. All monuments supplied by Tyrrells Memorials adhere to Australian Standards, with a guaranteed minimum lifespan of 50 years

 

Exclusions from Warranty Coverage

  1. The following circumstances and items are not covered under warranty:
  • Watermarks or stains that develop on light grey, pink, and dark grey imported granites.
  • Cracking of imported granite or marble ledgers (slabs) that occurs more than one year after installation.
  • Structural damage caused by ground collapse or the undermining of pier foundations due to cemetery excavation on adjacent graves.
  • Vandalism, extreme weather events, ground shifting, or natural deterioration of gold or painted finishes.
  • Anodised finishes on aluminium doors and windows, as well as bronze or stainless steelmotifs and ornaments.
  • Candle boxes, which are designed to be water-resistant but not completely waterproof, must have adequate ventilation to prevent moisture build-up.
